Legal Entity: Map Maven (Registered under the Laws of the Republic of Kenya)

Contact: legal@mapmavengmbexperts.com | abraham@mapmavengmbexperts.com

1. Binding Agreement & Service Preview Scope

By accessing duol.africa, submitting waitlist credentials, utilizing VIP access tokens, or streaming audio telemetry to DUOL, you enter into a legally binding contract with Map Maven. If you do not agree to every clause within these Terms of Service ("Terms"), you are strictly prohibited from accessing or using the platform.

All preview releases, including Waitlist Batch 1, VIP testing environments, and early API access, are pre-commercial preview services provided for testing and evaluation purposes.

2. Absolute AI Output Disclaimer & Non-Reliance Clause

DUOL utilizes probabilistic, non-deterministic artificial intelligence models (Fiti, Daudi, Rafiki, Rehema, and regional vernacular engines).

Zero Professional Advice: Outputs generated by DUOL do not constitute certified medical diagnosis, licensed legal counsel, formal financial or investment advice, or expert agronomic/agricultural guidance.

Assumption of Sole Risk: Voice models can generate incorrect, hallucinated, incomplete, or offensive information. You acknowledge that any reliance on generated responses is at your sole risk.

Exclusion of Real-World Damages: Map Maven assumes zero liability for financial losses, crop damage, personal injury, regulatory fines, or business decisions resulting directly or indirectly from reliance on DUOL outputs.

3. Voice Telemetry, Deepfakes & Acceptable Use Policy

You agree to use DUOL strictly for lawful purposes and warrant that you will not:

  • Unauthorized Recording: Record, stream, or transpose the voice of any third party without obtaining prior, express, and legally valid consent.
  • Synthetic Deception & Impersonation: Use DUOL to create non-consensual voice clones, deceptive deepfakes, extortion material, or false representations of private citizens or public officials.
  • Prohibited Content Generation: Generate, transmit, or promote hate speech, defamation, illegal acts, harassment, or explicit material.
  • System Abuse & Technical Attacks: Perform prompt-injection attacks, execute automated scraping, flood WebRTC streaming sockets, bypass waitlist verification, or reverse-engineer system prompts and model weights.

4. Waitlist Anti-Fraud & Referral System Integrity

To prevent queue manipulation, referral links must be distributed organically. Map Maven reserves the absolute right to audit referral activity, void suspicious referral credits, cancel VIP tokens, and revoke queue access without prior notice.

5. Intellectual Property Rights & Processing License

Map Maven retains exclusive ownership of all software code, voice model configurations, prompt architectures, dataset curation, audio streaming pipelines, visual assets, and the DUOL brand name.

You retain ownership of your original spoken prompts ("Inputs"), and grant Map Maven a perpetual, global, non-exclusive license to transmit, cache, and process Inputs to execute real-time responses across our cloud sub-processors.

7. Strict Limitation of Liability

Consequential Damage Waiver: Under no circumstances shall Map Maven, its founders, directors, employees, or cloud infrastructure partners be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost data, business interruption, or crop failure.

Financial Cap on Liability: Map Maven’s maximum cumulative monetary liability shall not exceed KES 5,000 (Five Thousand Kenyan Shillings) or the total fees paid by you in the preceding 12 months, whichever is lower.

8. Mandatory Indemnification (Hold Harmless)

You agree to defend, indemnify, and hold harmless Map Maven from and against any third-party claims, liabilities, costs, losses, or legal fees arising out of your violation of these Terms or reliance on AI outputs.

9. Dispute Resolution: Binding Individual Arbitration

Disputes shall be referred to and finally resolved by binding arbitration administered by the Nairobi Centre for International Arbitration (NCIA) in accordance with the Kenyan Arbitration Act, 1995 (as amended). The seat of arbitration shall be Nairobi, Kenya, conducted in English by a sole arbitrator.

10. Governing Law

These Terms are governed by and construed in accordance with the Laws of the Republic of Kenya.
